1. The ‘Terms of Use’ and the ‘Privacy Policy’ as contained on the website, (a Website run by the M/s Ondeal India Mkt. Pvt. Ltd. herein after referred as “Promoter” ) are to be treated as part and parcel of the present terms and conditions, to the extent the same are not in contravention to them.

2. Only an Indian Citizen who is 18 years of age shall be entitled to participate in “Scratchnwincontest2017” contest.
3. The order i.D of yours can be used only once for gift redemption, against the parcel ordered and received by you. Once the Product is Received and, the customer (you) need to clear your equerry Please mail us on care@ondealindia.co.in .
4. The gifts cannot be replaced with any other product or cash. The products you choose from our website are for personal use only and not for any other commercial purpose/ re-sale.
5. The Term: The validity of the Contest till 31st October 2017 .
6. The mega draw of the ScratchNwin contest shall be held on the expiry of The Term at Delhi or the city of the first prize Winner. The result shall be displayed on the Website of the promoter.
7. The Promoter, the operators of the Website, reserves the right to terminate this offer or any part thereof at any time without assigning any reason, if it is found that the customer has in any manner violated the Terms of Use, the Privacy Policy the present terms and conditions or for any other reason.

8. This SCRATCHNWINCONTEST2017 contest is for the benefit of the customers and no extra value in whatsoever form is charged from the customer for and on participation.

Also please note that Promoter is not running any cash laundry / lottery scheme, so please refrain yourself from making any payment if Sales executive does any mis-commitment regarding the same as ondealindia.co.in (ondealindia.co.in) won’t take any responsibility for such transactions.

Also the Promoter does not take any warranty and / or guarantee if the customer has shared his/her confidential personal or financial details with any employee of ondealindia.co.in

9.) Please note that in case it is found that your participation and confirmation for the contest is any way related to any oral or written commitment made by any of the Promoter’s representative, telecallers or your discussion with any person related to the Promoter, the Promoter shall have the right to and will initiate appropriate legal action against you and the said representative / person including but not limited to conspiracy and fraud against the Promoter, without prejudice to the Promoter’s other legal rights.

10.) You ( customer / shopper ) understand, agree and confirm they he / she have no right to defame the Promoter with respect to any issues and also agreed that in case of any issue, dispute or disturbance he/she will communicate to the representative/ customer care of the Promoter.

You surrender all your rights given by the law of land to express about the Promoter on any channel of communication in public. You also agree that in case of defamation evidence or proof is found against the blogger/shopper/customer , the penalty of Rs. 10 Lakhs will be levied or can be recovered by way of defamation proceedings or any legal proceedings.

11.) No inquiries shall be entertained by the Promoter regarding the winners list. In case you have any issue with your order or contest participation you can cancel your order within 2 days of your order date , post that no refunds / cancellations shall be entertained. Cancellation charges are 20% of the Order Value.

12.) The Promoter shall be at its sole discretion to award the prize/s to the next eligible customer , {* if you will be the lucky one customer only then you can win the grand prize (top 7)., otherwise you will not able to do any claim for the same }in the event the declared winner for that prize/s fails to arrive at the venue on the stipulated date and time, as intimated by the Promoter.

This decision of the Promoter cannot be challenged by the original winner or any one on his/her behalf, before any court/tribunal/forum/authority.

13.) The winner shall be liable to pay all applicable taxes/charges/levies/duties/excess on the gift won by him/her and shall accept the delivery at his/her cost and expense.

14.) A) All disputes, differences or issues of whatsoever in nature between the Promoter and Customer shall be referred to the sole Arbitrator appointed by the Promoter as per the provisions of The Arbitration and Conciliation Act, 1996.

B) All disputes are subject to the exclusive jurisdiction of competent courts and forums in New Delhi only

15.) The Promoter shall not be responsible for postal delays, transit losses or mutilation of the parcel.

Promoter shall not be liable for any failure to perform their obligation due to circumstances beyond the control or in event of any Act of God or “force majeure” circumstances including but not limited to fire, flood, labour strikes and dispute, put by any Government and/or Statutory Body and/or authority or any other reason.

18.) All other previous communications of whatsoever in nature prior to acceptance of this terms and conditions shall stand superseded by acceptance to this terms and conditions.
