Mountain Dew Jabong Promo

The ‘Mountain Dew Jabong promotion (‘Promo’) is being jointly organized by PepsiCo India Holdings Private Limited (“PIH”) and Novarris Fashion Trading Private Limited (“Jabong”) (collectively “Organizers”). The Promo is valid only on 250ml, 300 ml, 330ml, 500ml, 600 ml, 750 ml. 1.25 l, 1.5 l, 2 l and 2.25 l bottles of brand ‘Mountain Dew’ plying this offer, hereinafter referred to as ‘Products’.

Promo is valid from 1st September, 2017 to 31st October, 2017, both dates inclusive (‘Promotion Period’), in the territory of India except the states of Tamil Nadu and Kerala.

Participation is optional. Product also available without this offer.

Promo is open to all Indian citizens residing in India, above 18 years of age (‘Participant’). The Contest is not open to
(a) the employees of Organizers,
(b) their family members, Organizers’ associate companies, its bottlers, its JV partners, its co-packers, its distributors, its agents, its advertising and promotional agencies and its auditors and their associate companies,
(c) persons who are not “competent to contract” within the meaning of the Indian Contract Act, 1872, and
(d) the employees of Jabong and each of their respective affiliates (collectively, the “Jabong Entities”) and their family members.

How To Participate

i. The Participant will need to purchase any Product to participate in the Promo. The Participant has to look behind the label of the purchased Product, where he/she will find a 9 digit code (“Mountain Dew Code”) which has to be sent via SMS to the number indicated on the label.
ii. The Participant will receive an SMS confirming the participation/validity of the Mountain Dew Code.
iii. The Participant can participate in the Promo as many times throughout the Promo Period through purchase of the Product.
iv. Any participation without the Mountain Dew Code or with a fake code will be considered invalid.

v. The Participant will receive an SMS on the mobile number fed by the participant, from or on behalf of Jabong confirming the participation of participant. Vide the same or any other SMS, participant will be given a 16 digit voucher code (“Voucher Code”), which will entitle such participant to avail a discount of INR 500 (Indian Rupees Five Hundred only) on a purchase of a minimum of INR 1500/- (Indian Rupees One Thousand Five Hundred only) from the Jabong store on Jabong website i.e. Jabong.com/ (“Assured Prize”). The Voucher Code shall be valid till 31st December, 2017.

vi. Jabong is responsible for providing the Assured Prize to the Customers. One participant can get multiple unique Voucher Code by following the process indicated in point (iv) above. However, the redemption of the multiple Voucher Code shall be on different transactions and one voucher code can be used only once.

vii. The Voucher Code shall not be valid on the purchase of the following items on the Jabong website: gold coin, precious Jewellery, Watches, Innerwear,& Beauty,. Not applicable on bundles. All T&Cs mentioned for the Voucher Code on the website of Jabong shall be applicable.

viii. Any attempt to participate in the Promo without purchasing a Product plying this Promo or with a fake code, will be considered invalid.
ix. It is clarified that in addition to these terms and conditions, the Participant shall at all times be bound by the terms and conditions as imposed by Jabong on usage of its websites, microsites, applications, purchase of products, usage of vouchers etc.

x. PepsiCo India Holdings Pvt. Ltd. shall not be responsible for failure of Jabong to provide the Assured Prize to the Participant(s) or any downtime on the services, caused due to technical or other factors attributable at the end of Jabong that may occur for reasons including but not limited to failure of hardware equipment, configuration issue, decisions, change in marketing plans and / or changes in regulations that are carried out by any judicial or quasi-judicial or regulatory body.

xi. Participant agrees that participation in this Promo is at its sole risk. PepsiCo, Jabong, and their respective affiliates, and their officers, directors, employees, and agents disclaim all warranties, express or implied, including without limitation any warranty of merchantability, availability, and fitness for a particular purpose or non-infringement.

xii. The Prizes are non-transferable, non-returnable, non-refundable and non-negotiable. No requests for transfer or assignment or redemption of the benefits shall be entertained.
xiii. Valid for all payments modes. The offers under this Promo cannot be clubbed with any other offer.
xiv. The decision of Organizers shall be final with respect to all matters relating to this Promo and the result of this Promo and shall not be subject to review or appeal by any customer or by any third party.

xv. The authorized subscriber of the e-mail account used to enter the Promo at the actual time of entry will be deemed to be the participant and must comply with these terms & conditions in the event of a dispute as to entries submitted by multiple users having the same e-mail account.

The authorized account holder is deemed to be the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

xvi. Entry will be void if it is incomplete or if customer uses robotic, automatic, programmed or similar entry methods.

xvii. Organizers shall not be liable for:
i. any incorrect, incomplete or inaccurate information, whether caused by website users, or by any equipment or programming associated with or utilized in this Promo and assume no responsibility for any error, omission, interruption, deletion, defect, or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with website;

ii. any printing or typographical errors in any materials associated with the Promo, injury or damage to your or any other computer or mobile resulting from downloading any materials in connection with the Promo

xvii. All Jabong service related complaints/queries etc. shall be directly taken up by the participants with Jabong at care[AT]jabong.com or 0124-6128000.

Grand Prize

After receiving valid entries every 24 hours, the Organizer will take out 1 (one) winner for the Grand Prize which is a gaming [PIH1] Laptop throughout the Promotion Period. These winners will be taken out by the Organizers by using randomizer software. The decision of the Organizer shall be final and no further communication will be entertained.

It is clarified that in case the Participant wins a Grand Prize, the Organizer may at its sole discretion ask the claimant to mandatorily produce documentary evidence to prove that the participant bought the Product. In case, the claimant is unable to provide any such document to the satisfaction of the Organizer, the Organizer will have the sole discretion to either forfeit the prize or pass it on to the next winner claimant.
