POORVIKA –SLOGAN CONTEST :
POORVIKA – SLOGAN CONTEST is a Slogan Contest (“Slogan Contest”) provided by Poorvika Mobile World, a company incorporated under the provisions of Companies Act, 1956, having its registered office at NO.14/25 Chakrabani Steet, West Mambalam, Chennai 500033 (hereinafter called as “Poorvika”).

The Slogan Contest is valid from 17th July , 2015 till 16th Aug , 2015 (both days inclusive) between 12:00 noon to 10:00 pm (IST) (“Slogan Contest Period”) on purchase of select Samsung Galaxy Smart phones (hereinafter referred to as “Product”) from the outlets of

Poorvika, on the terms and conditions (“Terms”) mentioned below:
TERMS AND CONDITIONS :
I. General terms and conditions of the Slogan Contest:
1. The Slogan Contest is valid for Indian citizens who have attained the age of 18 years or above (“Participants”), except employees and family members of Poorvika and its affiliate / associate / subsidiary companies and their suppliers, advertising agencies and event management companies. Entries by person below age of 18 years shall be disqualified.

2. The Slogan Contest is applicable only on purchase of select Samsung Galaxy Smart phone models (priced above INR10,000) being G530 – Grand Prime, N7500 – Note 3 Neo, G7102 – Grand 2, I9300I – S3 Neo, A700 – A7, A500 – A5,A300 – A3, E500 – E5, E700 – E7, N9000 – Note 3, N910- Note 4, N915 – Note Edge, G925 – S6 Edge, G920 – S6,T231 – TAB 4, T705 – TAB S, T805 – TAB S etc. (“Product”).

3. This Slogan Contest is applicable only if the Participant purchases a Product during the Slogan Contest Period, from any Poorvika outlet in Tamil Nadu and Karnataka (“Outlet”) and follows the instructions mentioned hereinafter. Slogan Contest is not applicable on purchase of Product from online portal or any other Outlet other than Poorvika.

4. In order to participate the Participant needs to follow the following steps-:
a. Purchase any Product from the Outlet;

b. Activate the Product in the Outlet itself then give a missed call to 044 43 99 9977.

c. After giving the missed call, the Participant will receive a confirmation message along with a link to download the POORVIKA APP from Google Play store;

d. At the Outlet itself the Participant will have to install and open the Poorvika App, and click the CONTEST ICON displayed on the App.

e. On clicking the Contest Icon Participant will have to fill up his/her details in and give his/her suggestions / feedback;

f. After filing up the above details, Participant need to submit a slogan regarding “Customer buying experience of Samsung Smartphone in Poorvika in this festival season” and then click Submit

g. Upon submission of the slogan, he/she will get a message stating “Wait for 48 hours we will get back to you if you are a winner”.

5. Winners will be selected on the basis of slogan entries submitted. Ten (10) winners will be selected on daily basis for the following Prizes:

a) Honda bike Dream Neo 110cc (Ex showroom Price only) – First Best slogan entry to be selected from the entries received during the day.

b) Samsung LED 40H4200 – Second best slogan entry to be selected from the entries received during the day.

c) Samsung Refrigerator RT27JSMSASZ/TL third best slogan entry to be selected from the entries received during the day.

d) In addition to above prizes, there will be six (07) Samsung Galaxy Core 2 to be won every hour of the Slogan Contest Period. Winners will be selected from the slogan entries received during a particular hour.

E) In addition to above all the prizes, there will be a Mega Prize Winner also who shall be eligible to win a Volkswagen Polo Car (Trend Line petrol version (Ex showroom Price only). The Mega Prize Winner will be selected from the total slogan entries received during the Slogan Contest period. A Participant shall be eligible to receive only one prize during the Slogan Contest Period. Therefore the entries which have already been awarded with any of the Prizes shall not be eligible for the Mega Bumper Draw. Similarly, for the daily Prizes as well, any participant who has won the Galaxy Core 2 under the hourly contest shall not be eligible for other prizes for the day and also the Mega Bumper Prize.

6. There shall be a total 311 number of winners during the Slogan Contest Period. 310 being the Daily Prize winners and 1 Mega Prize Winner.

7. Winners will be declared on the following date of the submission of Slogan Contest entry. For example, the winners for entries received on 25th July 2015, will be declared on 26th July 2015 and so on. The Mega Prize winner shall be selected at the end of the Slogan Contest Period from all the remaining entries which have not been selected for any of the Prizes during the Contest period.

8. Winners will be contacted within 48 hours of submission of entries on the contact number provided and will get a message from Poorvika with a unique ID code.

9. Winners will have to go to nearest Poorvika Outlet or the same Outlet from where the purchase was made and show the message wherein they have been declared as a Winner.

10. The applicable tax for prize(s) will be borne solely by the winning participant. For Honda bike Dream Neo 110cc and Volkswagen Polo Car Poorvika shall bear only the Ex-Showroom Prize, rest of the amount as well as the applicable taxes will have to be borne by the winner.

11. Winner of the prizes would be required to send in advance a demand draft for an applicable amount towards tax in favour of “Samsung India Electronics Pvt. Ltd” payable at Chennai. Winning participants will be informed about the tax component on their mobile number shared by the participants.

12. In case of Samsung Galaxy Core 2, Prize will be handed over on the same day. Other Prizes will be handed over within 15 days of contacting Poorvika outlet. Winners will be required to carry their ID Proof, copy of PAN CARD and original invoice of the Samsung Smartphone purchased from Poorvika.

13. At the end of the Slogan Contest Period, the final results declaring all the winners for this Contest shall be uploaded on website

14. The participation in the Slogan Contest is voluntary. Participation in this Slogan Contest constitutes acceptance of these terms and conditions. By availing this Slogan Contest, Participant(s) agrees to receive communication(s) from Poorvika and/or its event management company relating to the Slogan Contest and Participant(s) unconditionally agrees not to make any claim or raise any complaint against Poorvika and/or the event management company in this respect.

15. Availing the Slogan Contest implies that Participant agree to all Terms of the Slogan Contest. Anybody found using any unfair means will be immediately disqualified.

16. By availing the Slogan Contest, the Participant hereby consents to the accessing of information and/or images of the Participant by Poorvika and/or its event management company for the purpose of this Slogan Contest. Further, Poorvika shall be at liberty to use the entries received for its media coverage, advertisement or publicity in any form which is existing today.

17. Participant agrees that all/any pictures appearing in Slogan Contest are fictitious and any resemblance to real persons, living or dead, is purely coincidental. Pictures and images shown in the promotional material for the Slogan Contest or on the website are visual representations and the actual prize, and their colors, model numbers and/or features may differ.

18. Poorvika reserves the right to reject any Participant’s entry on any grounds without the need to notify the Participant of the reasons for rejection.

19. Poorvika also reserves the right to amend/modify the terms and conditions or any part thereof at its sole discretion without prior notice. It also reserves the right to substitute the Prize(s) under this Slogan Contest with Prize(s) of equivalent value at its sole discretion without prior notice. The color, make and model of the Prize(s) shall be as per the sole discretion of Poorvika and will not be changed at the request of the winner.

20. All Prizes provided under this Slogan Contest shall be on ‘As Is’ basis.

21. No other Slogan Contests can be clubbed with this Slogan Contest

II. Representation and Warranties by Participant:
1. Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking availing the Slogan Contest, the Participant warrants that all information provided by the Participant regarding its name, age, state, city, address, phone number, etc., is true, correct, accurate and complete and that the Participant is authorized to provide such information and consents to the use of such information by Poorvika and/or its event management company.

2. Participant agrees and consents that any and all information submitted by the Participant including but not limited to the submissions and personal information of the Participants may be required to be shared with other third parties engaged by Poorvika, for the purposes of verifying and/or audit the authenticity of the entries received from the Participants. Further, the Participant hereby understands that such third parties may be located outside the jurisdiction of India and notwithstanding anything, each Participant consents to transfer of information (including any personal information) to any such locations.

3. Participant agrees that Poorvika shall not be liable for any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Slogan Contest or with the acceptance, possession, or use of any prize (except any liability which may not be excluded under applicable law).

4. Participant hereby agrees to indemnify and keep Poorvika, its associate companies, its event management company and their respective directors, officers, employees, contractors and agents, indemnified against any and all losses, claims (including but not limited to third party claims), injuries, costs, fees, fines, penalties, taxes, charges and any other liability arising out of any act of omission, commission, fraud, negligence or misconduct by the Participant.

5. The Participant agrees that this Slogan Contest only valid on the purchase of brand new Product during the Slogan Contest Period from Poorvika Outlet only and is not valid on the sale of second hand, refurbished, category Product etc.

6. This Slogan Contest is not valid on purchases made on e-commerce websites, B2B business and other Organized Trade Outlets.

7. Participants shall be required to show/submit a copy of the Identity Card to Poorvika Outlet.

III. Disclaimers:
1. This Slogan Contest is provided solely by Poorvika at its sole discretion and Samsung disclaims any and all claims in respect of the same. Under no circumstances shall Samsung and/or its affiliates and/or their directors, officers, agents or employees be held responsible for any claims, responsibilities, liabilities etc. arising out of this slogan contest.

2. Poorvika shall not be responsible for system outages, delays, equipment malfunctions, errors or data loss of any kind, lost or unavailable connections, or failed, incomplete, garbled or deleted transmissions or other technological difficulties or any other force majeure event that may prevent a Participant from participating in the Slogan Contest. Further, Poorvika will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions, Gifts or entries; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the promoter; or (e) any printing or typographical errors in any materials associated with the Slogan Contest or (f) any delay, damage, non receipt, lost, misrouted prize.

3. Poorvika shall not be liable for delay in delivery prize due to non-availability of stocks or for any other reason beyond its control.

4. Poorvika has the right to cancel entries with incomplete information or illegal contents (statements of a racist, sexist or defamatory nature) or statements glorifying violence which could be construed as deriding or insulting or similarly offending specific individuals or groups.

5. The Prize cannot be exchanged with any product or item, is non-transferable and cannot be en-cashed under any circumstances. Accessories, if any shown with the prize picture may not form part of Prize to be provided to the Participant(s). The decision of Poorvika in respect to the Prize shall be final and no dispute shall be entertained in this regard. All Prizes are provided on “As Is” basis and Poorvika disclaims any and all warranties for the same.

6. Poorvika shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss. Standard manufacturer’s warranty, if any, shall be applicable for all Products.

7. Poorvika reserves the absolute right to amend the Terms of the Slogan Contest or extend the Slogan Contest Period or cancel or discontinue the Slogan Contest or any part thereof without giving any reasons or prior notice.

8. Slogan Contest shall be void in any state where it is prohibited by law. In such case, Poorvika shall not be liable to provide any free cash-back, gift(s) or compensation to the Participant on any account.

9. Failure by Poorvika to enforce any of its right at any stage does not constitute a waiver of those rights.

10. Any postings of pictures by Participant will be presumed by Poorvika as consented by Participant or subject to fulfillment of any IPR related formalities by such Participant. Poorvika shall always trust the same in good faith, unless any claim is made by any third party, for which the Participant hereby indemnifies Poorvika India for all claims, costs, damages, risks and expenses.

11. In no event shall Poorvika be liable for losses or any incidental or consequential damages arising out of or in connection with the Slogan Contest, its services these Terms (however arising, including negligence). Poorvika shall not be responsible for any product or service liability of any kind.

12. In the event of any conflict or inconsistency regarding any instructions, rules and conditions on any advertising or promotional material relating to the Slogan Contest, these Terms shall prevail over all such other instructions, rules and conditions.

13. Slogan Contest is subject to validation, including without limitation, verification of eligibility through checks as deemed appropriate by Poorvika and complete compliance with these Terms; Poorvika reserves the right to verify the Participant(s)’s and/or Product’s details either on its own or through its authorized agency / person and the Participant(s) shall provide all necessary assistance in such verification. In exercising this right, the Participant(s) may be required to provide any documentary or other form of evidence, and if evidence does not establish the same then Poorvika, in its sole discretion, will have the right to disqualify the Participant(s).

14. Nothing herein, shall be construed as conferring any license or other rights under the intellectual property or other proprietary rights of Poorvika or its related companies or any third party, whether by estoppels, implication or otherwise and all such rights shall remain the sole and exclusive property of Poorvika and/or its related companies.

15. Poorvika will not accept any responsibility of licensing and copyright issues of the used images.
