If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant’s or any other person’s mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.

Caution:
any attempt to deliberately damage the Promoter’s promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

If the Promoter suffers loss or incurs any costs in connection with any breach of these Terms or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.

These terms and conditions apply to the “Britannia Marie Gold Contest” activation programme for consumers (hereinafter referred to as ” Contest”) sponsored and launched by Britannia Industries Ltd (hereinafter referred to as “BIL”) wherein consumers can participate by sending an SMS with the keyword ‘MARIEGOLD’ followed by the Lot Number printed on the pack to 56767 or logging.

The contest is valid only in India from 15th August 2015 to 3rd October 2015 (herein after referred to as “Contest Period”).

During the Contest Period one DAILY PRIZE(I-PHONE) will be awarded to winner who will be selected on each day of the Contest, , subject to the conditions duly fulfilled by the shortlisted winner.

All IPR rights including trademark, copy right and designs used are the property of their respective owners. Premier Sales Promotions has not taken any permission to use any of the product images, name, logo etc.

The Contest is subject to all applicable central, state and local laws and regulations.

Consumers participating or seeking to participate in the Contest shall individually be referred to as “Participant” and collectively as “Participants”.

Agreement to Terms and Conditions:
By participating in this contest, Participants fully and unconditionally agree to and accept these Terms and Conditions available on (“Contest Website”) as well as the decisions of BIL, which are final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to all requirements set forth herein.
BIL reserves the right to exclude any person from the contest on grounds of misconduct or criminal record.
BIL reserves the right to terminate, modify or extend the Contest, at any time at its absolute discretion, without assigning any reason. All decisions of BIL in respect of the Contest and the prizes therein will be final and binding.

Eligibility :

This Contest will be open to all the residents of India with the exception of BIL and its subsidiary employees, their immediate family members, agents, distributors, retailers and any other channel partner of BIL and the agency.
People below 18 years shall be allowed to participate with their parents or guardians providing the necessary documentation on behalf of the minor. In such a case, the parent (s) or legal guardian of the minor may redeem the prize at his / her own cost and shall execute the documents as required.

In order to be eligible for the daily prize, all shortlisted winners will be required to have valid address and a PAN card.
BIL or its Agency will not be responsible for any NDNC (National Do Not Call) Registry regulation that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), BIL or its Agency will have all the authority to call such shortlisted winners by virtue of them having voluntarily participated in the Contest.

Contest Period & Contest Timings :

The contest will commence from midnight 15th August 2015 to 3rd October 2015.
The Participants can make an entry any time during the Contest Period but the daily winner generation will be for the entries received on previous day midnight (12 am) to current day midnight (12am) (here in after referred as “Contest Timings”).

Time of participation will be defined as the time at which the entry is received through the SMS mode or the Online mode of participation at BIL computer.

Entries coming outside the Contest Period will not be considered for winner selection.
The contest shall run on the all SKU of Britannia Marie Gold only.

Daily Prize :

Daily Prize – Participants will be chosen each day between midnight of previous day to midnight of current day (12 am to 11.59pm) during the Contest Period. Participants will be chosen through a computerized, scientific random selection by BIL or the Agency appointed by BIL.
There will be one I-PHONE to be won daily during the Contest period.

How to Participate :

Any participant can enter the contest maximum 5 times only, per day from a mobile number either through SMS or WEB. To participate in the Contest, customers have to send an SMS to 56767 and follow the instruction to complete the participation: SMS route for Rest of India

As a first step, Participants are required to send an SMS with the keyword ‘MARIEGOLD’ followed by the Lot Number printed on the pack to 56767 from any GSM or CDMA mobile phone. e.g. SMS MARIEGOLD B1015438 to 56767
After sending the SMS, Participant will get SMS with reference to the contest.

SMS route for Tamil Nadu :

As a first step, Participants are required to send an SMS with the keyword ‘MARIEGOLD’ followed by the Lot Number printed on the pack to 56767 from any GSM or CDMA mobile phone. e.g. SMS MARIEGOLD B1015438 to 56767
After Participants SMSes MARIEGOLD followed by the Lot Number printed on the pack to 56767 during the Contest Period they will get a simple question (I love Marie because..) to answer via an SMS response.

Participants will be required to send SMS in the following format: MARIEGOLD followed by their answer to 56767 to complete participation.

After sending the SMS, Participant will get SMS with reference to the Contest.

If the Participant sends an SMS in valid format within the Contest Period, he/she will receive a valid response via SMS and such entries will be considered for winner selection. The participant shall have to pay premium charges to their respective telecom service providers for sending the SMS to 56767. BIL and the Partner Agency shall not be responsible for (including but not limited to): I. For any SPAM generated messages II. For the Operator Code not being displayed on the user’s mobile phones III. For any SMS message delivery failures IV. Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason V. If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign VI. Other conditions beyond its reasonable control

Online route for Rest of India :

As a first step, Participants are required to log on to the contest website and follow the instructions on the website to complete participation.

Participants will be required to enter the lot number printed on the pack as per instructions on the website, and their mobile no, email id and City in the format mentioned online.

There will be no charges for entries made online other than the charge to respective Internet Service Providers for the internet usage.

If the Participant logs on to the website after completion of the Contest Period, the Participant will be informed that the Contest Period is over and therefore no entries can be accepted.

Online route for Tamil Nadu :

Participants can log on and follow instructions on the website to participate in the Contest.
Participants will be required to enter the lot number printed on the pack as per instructions on the website, and their mobile no, email id and also answer a simple question in the format mentioned online to complete the participation.
There will be no charges for entries made online other than the charge to respective Internet Service Providers for the internet usage.

If the Participant logs on to the website after completion of the Contest Period, the Participant will be informed that the Contest Period is over and therefore no entries can be accepted.

Winner Selection :

A draw through random scientific selection will be conducted every day as per below.
Winner for 1st day will be selected on the next day from the pool of valid entries (Valid entries means entries received between 00:00:01 to 23:59:59 of that day) received during the first day.
The prize will be an I -_PHONE . No claim regarding the model/ make of the prize shall be entertained. Decision of BIL/ its agency shall be final and binding.

Prizes will be given subject to the winner satisfying the verification process of BIL.
The Prize cannot be transferred, exchanged or redeemed for cash. In the event that the winner does not take the prize in the time and manner stipulated, then the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied.

Any unused prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken in exchange for cash.

BIL shall provide the prize on an “as-is basis” and without any warranty or guarantee concerning the quality, suitability or comfort, and BIL and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/ or defect of any product/service and/or the prize or for any kind of consequential damages/ loss, in any manner whatsoever.

If any Participant has any grievance with respect to the prize, he/she may directly contact the manufacturer.
The image of the prize depicted on the press ads/posters/TVC’s/pack shots etc. are for illustrative purposes only and the actual prize may vary from the depiction made.

BIL or its Agencies shall not be liable for any loss or damage of the prize due to Act of God, Governmental action and other Force Majeure circumstances and shall not be liable to pay any compensation whatsoever for such losses.
TDS applicable on the I_PHONE will be borne by BIL.

Any participant of the contest who wins a prize during the Contest Period shall not be eligible to win any further prizes.
The winner generation will be done on the basis of Valid Lot Number + Unique mobile number + Unique PAN Card.

Contacting Winners :

DAILY PRIZE
Once the Participants are shortlisted, the Partner Agency appointed by BIL shall contact each on the number from which the SMS entry has been made or indicated whilst making an online entry.

In the event the shortlisted winner’s number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Participant on that day and/or the next day. If even on the third attempt, the Participant does not attend the call, or is unreachable, the Participant’s participation in the contest comes to an end and the Participant’s entry stands canceled and Participant becomes ineligible to receive the prize.

In the event the shortlisted winner attends the call on either the second or third attempt, the procedure outlined in step (v) shall apply.

If any shortlisted winner remains unreachable on the third attempt or is not interested in continuing in the Contest or is otherwise ineligible to participate, the Agency shall conduct up to two (2) more random selections to shortlist a Participant. If even after a third random selection, no winner is selected, no prize shall be declared in respect of that particular day of the contest.

In case of a positive response from the shortlisted winner, each such shortlisted winner will be required to send the following documents and collateral:

The Britannia Marie Gold wrapper with the lot number clearly visible that was entered by the consumer in the entry via any of the two modes of participation. Address proof (Electricity bill, Mobile bill, Valid Indian Passport) Copy of PAN card is mandatory.

This will be referred to as Participation Package for the winner. The completed Participation Package needs to be sent by registered post with Acknowledgement Due to the address mentioned below or by courier so as to reach within 7 days of the call made by Agency to the selected winner:

Upon receipt of the Participation Package, BIL or its Partner Agency shall scrutinize all documents. If all the documents and the wrapper submitted are in order and valid then be treated as a Confirmed Winner.

The prize will be dispatched to the Confirmed Winners after the above formalities are successfully completed within 45 business days from the date of completion of formalities of the confirmed winner.

No prize will be awarded if the information presented by the Participant(s) at the time of entering the contest is not factually correct.

The cost and expenses of postage shall be borne by the participant himself. BIL or the Partner Agency shall not be responsible for any accident or mishap or loss of the Participation Package by the participant in transit. The responsibility of ensuring that the Participation Package reaches the address as directed by BIL or its Partner Agency lies solely with the participants.

No justification/explanation for non-receipt of the Participation Package or any missing documents shall be accepted.

In the event of death of the Confirmed Winner, no claim from the nominee or his/her legal heirs of the Confirmed Winner shall be entertained for receiving the prize.
